I have a 2001 X5 and have had similar problems with Keys and seat memory. But to fix it.

1. Shut the doors and lock the vehicle with the key
2. Unlock the vehicle with the key
3. Open the door and push the button on the seat you want the key to remember.
4. Put the key in the ignition and turn to position 2
5. Turn off ignition
6. Shut the door (do not lock it)
7. Open the door
8. Insert key and turn back to Position 2.
9. Key will now remember that setting
10. Repeat for other key

It took me 20 minutes to figure that out with mine. I don't understand why but this worked for mine.
