I had (and loved) an E38 for a couple of years, but once its CPO warranty was about to expire, I had to move on.

I went with a new '06 550i and have loved every minute of it. If you enjoy a very driver oriented experience, you really should try to save up a few extra bucks to go with the 545/550 car. The acceleration is absolutely fantastic. I also went with the Sport Package, which I think is an absolute MUST have to really drive the car the way its meant to be driven. If you enjoy a manual transmission car, its a hell of a sports sedan with the 6mt transmission.

My car just turned 2 years old last week, and knock on wood, its been very solid. No issues at all - it burned a little oil at the start, but has settled in and been nothing short of amazing.

What more can I tell you? It takes a bit of getting used to, going from a luxury sedan like the 7 series to a 5 series, but trust me, from a driving perspective, you'll never miss the e38 when you're hitting the twisty road!
